This Acceptable Use Policy (the "Policy") forms part of our Terms of Service and applies to everyone who uses the Nice fleet platform or our website. It exists so that one customer's misuse cannot degrade the service, safety or privacy of another.
You are responsible for the conduct of everyone using accounts your organization controls, including employees, contractors, drivers and the families you give access to.
1. Do not misuse the service
You must not, and must not permit anyone to:
- use the service for any unlawful purpose, or in breach of any transportation, safety, employment, privacy or export law that applies to you;
- upload or transmit anything unlawful, defamatory, harassing, abusive, or that infringes someone else's intellectual property or privacy rights;
- impersonate any person or organization, or misrepresent your affiliation with one;
- share login credentials between people, or allow anyone to use an account not issued to them;
- attempt to access data belonging to another customer, another company, or any individual outside the scope of the account's role;
- circumvent, disable or interfere with any security, authentication, rate-limiting or access-control feature;
- probe, scan or test the vulnerability of the service without our prior written permission (see section 5);
- introduce malware, or anything designed to disrupt, damage or gain unauthorised access to any system or data;
- place an unreasonable load on the infrastructure, including through automated scraping, bulk export loops or denial-of-service behavior;
- reverse engineer, decompile or attempt to derive source code, except to the extent that restriction is unenforceable by law;
- resell, sublicense, or provide the service to a third party as a service bureau, without our written agreement; or
- use the service to build or assist in building a competing product.
2. Rider, student and family data
These carry the highest expectation of care, and the rules are stricter.
- Collect and upload the minimum rider information needed to run the trip. Do not upload government identification numbers, financial details, immigration status, or health information beyond a stated accessibility requirement.
- Grant parent and guardian access only to a person entitled to it under your own policies and applicable law. Verifying that entitlement is your responsibility, not ours.
- Remove access promptly when a custody arrangement, enrolment or employment ends.
- Do not use rider location data for any purpose other than delivering and communicating about transportation — never for marketing, and never to monitor an individual outside the service window.
- Do not export rider or student data to a third party unless you are permitted to, and have a written agreement with them covering it.
3. Driver and employee monitoring
The Platform records vehicle location while a driver is on shift, along with inspections, stop confirmations and hours. You are responsible for:
- notifying drivers that this occurs, in the manner your jurisdiction and any collective agreement require;
- obtaining any consent the law requires; and
- using the data lawfully and proportionately in employment decisions.
We do not police how you use it, and we are not a party to your employment relationships.
4. Accuracy and operational responsibility
The Platform supports your operation; it does not run it. You remain solely responsible for vehicle safety, driver licensing and qualification, inspections actually being performed, hours-of-service compliance, and the decisions your dispatchers make. Do not represent to a customer, district or regulator that our software discharges an obligation that in fact remains yours.
5. Security research
We welcome good-faith reports. If you want to test the service, write to info@nicetechnologiesinc.com with "Security" in the subject before you begin, and tell us what you intend to do.
Good-faith research that follows this Policy, stays within scope we agree, does not access or exfiltrate data belonging to others, does not degrade the service, and gives us reasonable time to fix before disclosure, will not be pursued by us. We will acknowledge your report, tell you what we find, and credit you publicly if you would like.
6. What happens if this Policy is breached
Depending on severity we may: contact your administrator; require a specific remedy within a stated time; throttle or restrict a function; suspend an account or the whole tenant; or terminate the agreement for material breach.
Where there is an immediate risk to safety, to personal data, to the service or to another customer, we may suspend without prior notice, and will tell your administrator as soon as we reasonably can with the reason and what is needed to restore access.
Where we are required to report conduct to a regulator or law enforcement, we will.
7. Reporting misuse
To report a breach of this Policy — including by another user of your own organization — email info@nicetechnologiesinc.com. Include what you saw, when, and the account, vehicle or route involved if you know it.
8. Changes
We may update this Policy as the service and the threats to it change. The date at the top shows when it last changed. For material changes affecting active customers we will give at least 30 days' notice to the account administrator.
